ZBrains (“ZBrains” or the “Company”) is firmly committed to protecting the privacy of any and all individuals who visit ZBrains’s website(s) (“Visitors”), as well as any and all individuals who register or purchase professional services and/or products as provided by ZBrains (“Customers”), including but not limited to Business Process Consulting, Cloud Integration, Workflow Automation, Web Development and CRM Consulting. This Privacy Statement describes in detail the privacy practices that the Company implements in its use of it’s own websites and related applications with regards to ZBrains’s professional services and products (technological consultation, product support services, maintenance services, VIP Zoho CRM Support and/or Implementation Plans, etc.), along with computer software and directly related materials relevant for operation of said software, including source documentation, manuals, and other information acquired in conjunction with, and necessary for, the professional services provided by ZBrains to Customers, as provided by the Company, in conjunction with its websites and personal data usage.
ZBrains’s Privacy Statement applies solely to the information collected by the ZBrains’s websites and related applications. The Company’s Privacy Statement provides notification of the following:
- What personally identifiable information is collected from Visitors and/or Customers through the ZBrains’s website(s), how it is used and with whom it may be shared;
- What choices are available to Visitors and/or Customers of the ZBrains’s website(s) with regards to the use of their data;
- What security measures are in place to protect the misuse of Visitors and/or Customers information; and
- How Visitors and/or Customers can correct any inaccuracies in the information obtained via the Company’s website(s) and related applications.
§1. Website(s) Covered by the Privacy Statement.
This Privacy Statement covers the information practices of ZBrains’s website(s) and related applications that link directly to this Privacy Statement, including: https://www.agilebts.com, https://zbrains.net, https://agilitysync.com, https://fieldtech.io. ZBrains or third parties may post applications on https://zbrains.net, and when such posts occur where the posted application links to this Privacy Statement, this Privacy Statement applies. When applications are posted by third parties on https://zbrains.net, the privacy statement of the third parties applies, while this Privacy Statement is not applicable.
ZBrains’s websites, including https://zbrains.net, may contain links to other websites and any information practices or content from these websites are covered by their privacy statements, not this Privacy Statement. ZBrains’s Visitors and Customers that follow links found on https://zbrains.net to other websites are encouraged to thoroughly review the privacy statements of these other websites to understand their specific information practices.
§2. Specific Information Collected.
When Visitors and/or Customers inquire about ZBrains’s professional services and/or products via the Company’s website(s), ZBrains’s requires that Visitors and/or Customers provide the Company with personal contact information, to include name, company name, address, phone number and email address (“Required Contact Information”). If Visitors and/or Customers want to purchase the Company’s professional services and/or products via the ZBrains website(s), ZBrains may require Visitors and/or Customers to provide the Company with qualifying financial data and billing information, to potentially include billing name and address, credit card number and the number of employees within the organization that will be using the professional services and/or products of ZBrains (“Billing Information”). ZBrains may request additional information via their website(s) in the form of company-specific data, specifically annual revenues, employee count, or type of industry (“Optional Information”). These three types of information (Required Contact, Billing and Optional) about ZBrains’s Visitors and/or Customers are referred to collectively in this Privacy Statement as “ZBrains Visitor/Customer Data”.
Navigation of the Company’s website(s) by Visitors/Customers may also trigger the collection of information through the use of information-gathering tools known as cookies and/or web beacons. The type of information gathered by cookies and/or web beacons on ZBrains’s website(s) include standard information from one’s web browser, including browser type/language, Internet Protocol (“IP”) address, and any activity a Visitor and/or Customer may engage in on the Company’s website(s), such as web pages viewed and any links clicked upon.
§ 3. Use of Information Collected.
The Company uses Data acquired from Visitors and/or Customers who navigate and use the ZBrains website(s) in order to perform any services requested. For example, if a Visitor/Customer completes the “Contact Us” web form as found on the Company website(s), the Company will use the information provided to contact the individual about interest in ZBrains’s Professional Services and/or Products.
The Company may also use Data acquired from Visitors and/or Customers who navigate and use the ZBrains website(s) for marketing purposes. For example, ZBrains may use information provided by Visitors and/or Customers to contact them to further discuss interest in ZBrains’s Professional Services and/or Products and to possibly send them information regarding the Company, its affiliates, and its partners, such as information about promotions or events. ZBrains would use credit card information ONLY to check the financial qualifications and collect payment from prospective ZBrains Visitors and/or Customers who provide such information via the ZBrains website(s), for purposes of acquiring VIP Zoho CRM Support and/or Implementation Plans or other professional services and/or products as provided by ZBrains.
ZBrains also uses information gleaned through the use of information-gathering tools known as cookies and/or web beacons from the navigation of the Company’s website(s) by Visitors/Customers, to operate and improve the Company’s websites. The Company may also use website navigational information alone or in combination with data about ZBrains’s Visitors and/or Customer to provide personalized information about the Company.
§4. Navigational-Accrued Information (Cookies & Web Beacons).
ZBrains uses commonly used information-gathering tools, such as cookies and web beacons, to collect information as Visitors and/or Customers navigate the Company’s website(s) (“Navigational-Accrued Information”). This section describes the types of Navigational-Accrued Information found on the Company’s website(s) and how this information may be used.
The Company uses cookies to make interactions by Visitors and/or Customers with the ZBrains website(s) simple and productive. When Visitors and/or Customers visit the Company’s website(s), ZBrains’s servers send a cookie to Visitors and/or Customers computers. Standing alone, cookies do not personally identify anyone specifically; they merely recognize a Visitor and/or Customer’s web browser. Unless Visitors and/or Customers choose to identify themselves to ZBrains by filling out a “Contact Us” web form, or purchase a VIP Zoho CRM Support and/or Implementation Plan, they remain completely anonymous to the Company.
ZBrains uses cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from one’s computer after closing the browser software or turning off the computer. Persistent cookies remain on your computer after closing the browser or turning off the computer.
The following illustrates how ZBrains uses different categories of cookies in obtaining data from ZBrains’s Visitors and/or Customers:
- Required cookies: enable you to navigate the Company’s website(s) and use its features, such as accessing secure areas of the website(s) and/or purchasing a VIP Zoho CRM Support and/or Implementation Plan. If a Visitor and/or Customer of ZBrains’s website(s) has chosen to identify themselves to ZBrains, the Company uses cookies containing encrypted information to allow the Company to uniquely identify such a Visitor and/or Customer. These cookies allow the Company to uniquely identify an ZBrains Visitor and/or Customer in order to process online transactions and requests;
- Performance cookies: these cookies collect information about how Visitors and/or Customers use the ZBrains website(s), including which pages they go to most often and if they receive error messages from certain pages. These cookies do not collect information that individually identifies a Visitor and/or Customer of ZBrains. All information these cookies collect is aggregated and anonymous. It is only used to improve how the Company’s website functions and performs.
IP Addresses: When ZBrains’s Visitors and/or Customers visit the Company’s website(s), the Company collects their Internet Protocol (“IP”) addresses to track and aggregate non-personal information. For example, ZBrains uses IP addresses to monitor the regions from which Customers and Visitors navigate the Company’s website(s).
Social Media Features: ZBrains’s website(s) may use social media features, such as links to the Company’s Facebook, Twitter, Google Plus and LinkedIn pages (“Social Media Features”). These features may collect Visitors and/or Customers IP addresses and which page you are visiting on the Company’s website(s) while using the social media links to access ZBrains’s specific social media Company pages, and may set a cookie to enable the feature to function properly. Visitors and/or Customers may be given the option by such Social Media Features to post information about their activities on the Company’s website(s) or to the Company’s social media pages found on Facebook, Twitter, Google Plus and LinkedIn, or to a profile page of Visitors and/or Customers that is provided by a third party Social Media network in order to share with others within their network. Social Media Features are either hosted by a third party or hosted directly on the ZBrains website(s). Visitors and/or Customers’ interactions with these features are governed by the privacy policy of the company providing the relevant Social Media Features (e.g., Facebook, Twitter, Google Plus and/or LinkedIn).
§5. Public Forums and Customer Testimonials.
ZBrains may provide bulletin boards, blogs, or chat rooms on the Company’s website(s). Any personal information that ZBrains’s website(s) Visitors and/or Customers choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send unsolicited messages. ZBrains is not responsible for the personal information Visitors and/or Customers choose to submit in these forums.
ZBrains may post a list of Customers and testimonials on the Company’s website(s) that contain information such as Customer names and titles. ZBrains would obtain the consent of each Customer prior to posting any information on such a list or posting testimonials.
§6. Sharing of Collected Information.
ZBrains may share Data about ZBrains’s website(s) Visitors and/or Customers with the Company’s contracted service providers so that these service providers can provide services on our behalf. Without limiting the foregoing, ZBrains may also share Data about their Visitors and/or Customers with the Company’s service providers to ensure the quality of information provided, and with third-party social networking and media websites, such as Facebook, Twitter, Google Plus and LinkedIn, for marketing and advertising on those websites. Unless described in this Privacy Statement, ZBrains does not share, sell, rent, or trade any information with third parties for their promotional purposes.
The Company may share Data about ZBrains’s website(s) Visitors and/or Customers with other companies in order to work with them. For example, the Company may need to share Data about ZBrains’s Visitors and/or Customers for customer relationship management purposes. Occasionally, ZBrains may partner with other companies to jointly offer products or services. If ZBrains’s Visitors and/or Customers purchase or specifically express interest in a jointly-offered product or service from ZBrains, the Company may share Data about ZBrains’s Visitors and/or Customers collected in connection with their purchase or expression of interest with ZBrains’s joint promotion partner(s). ZBrains does not control our business partners’ use of the Data about ZBrains’s Visitors and/or Customers we collect, and their use of the information will be in accordance with their own privacy policies. If ZBrains’s Visitors and/or Customers do not wish for your information to be shared in this manner, they may opt not to purchase or specifically express interest in a jointly offered product or service.
This Privacy Statement sets forth the information ZBrains collects on the Company’s website(s) and the information shared with third parties. ZBrains does not authorize the collection of personal information by third parties through advertising technologies deployed on the Company’s website(s), nor do we share personal information with any third parties collected from the Company’s website(s), except as provided in this Privacy Statement. Section 4 of this Privacy Statement, specifically addresses the information collected from ZBrains’s Visitors and/or Customers through cookies and web beacons.
ZBrains uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf. ZBrains reserves the right to use or disclose information provided if required by law or if the Company reasonably believes that use or disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.
§7. ZBrains’s Customer Data.
ZBrains’s Customers may electronically submit data or information for hosting, purchasing and processing purposes via ZBrains’s website(s) (“Customer Data”). ZBrains will not review, share, distribute, or reference any such Customer Data except as provided in the ZBrains Master Services Agreement (“MSA”), or as may be required by law. In accordance with the ZBrains MSA, ZBrains may access Customer Data only for the purpose of providing their Professional Services, Consulting and Products, or preventing or addressing service or technical problems or as may be required by law.
§8. Security.
To protect from unauthorized access and use the limited personal information that is collected from Visitors and/or Customers to ZBrains’s website(s), ZBrains performs the following security processes:
- use of reasonable security procedures, including secured files, user authentication, encryption, firewall technology and detection software;
- detailed review by ZBrains’s security officers of the data security practices of any and all companies that ZBrains may share even the smallest bit of Visitor and/or Customer personal information and data with;
- ZBrains only grants access of Visitor and/or Customer personal information as acquired through ZBrains’s website(s) to those within the ZBrains hierarchy who must have access to it for purposes of doing their job to provide a professional service or product to said Visitors or Customers – the margin for error is therefore minimized and security strengthened due to this limited access.
§9. Mobile Applications.
Without limiting the generality of this Privacy Statement, in addition to information gathered through its website(s) or submitted to its Services, ZBrains may obtain information through applications (“Mobile Applications”) that Visitors and/or Customers or their authorized individuals (“Users”) download to, and run on, their mobile devices (“Devices”). Mobile Applications provided by ZBrains may obtain information from, or access data stored on, Users’ Devices to provide services related to the relevant Mobile Application. Information obtained to provide Mobile Application services may include information obtained in preparation for anticipated updates to those services. Mobile Applications may transmit information to and from Devices to provide the Mobile Application services.
Mobile Applications may provide ZBrains with information related to Users’ use of the Mobile Application services, information regarding Users’ computer systems, and information regarding Users’ interaction with Mobile Applications, which ZBrains may use to provide and improve the Mobile Application services. For example, all actions taken in a Mobile Application may be logged, along with associated information (such as the time of day when each action was taken). ZBrains may also share anonymous data about these actions with third party providers of analytics services. In addition, if a User downloads an ZBrains Mobile Application after clicking on a third-party mobile advertisement for the Mobile Application or for an ZBrains website, the third-party advertiser may provide ZBrains with certain information, such as the User’s Device identification information, which ZBrains may use to track the performance of its advertising campaigns.
ZBrains’s Visitors and/or Customers may configure ZBrains’s Mobile Application services, and the information accessed or obtained by the Mobile Application on a User’s Device may be affected by the Visitors and/or Customer’s configuration. In addition, if a Visitor and/or Customer purchases more than one professional service or product from an ZBrains website(s), a Mobile Application may be designed to interoperate with those Services or Products; for instance, to provide a User with access to information from any or all of those professional services or products or to provide information from a User’s Device to any or all of those purchases. Information accessed or obtained by the Mobile Application on a User’s Device may be accessible to the ZBrains’s Visitor and/or Customer and their organization, depending on the intended functionality of the Mobile Application.
In addition to Mobile Applications offered by ZBrains, the Company may offer platforms for the creation of third-party Mobile Applications. Third parties may obtain information from, or access data stored on, Users’ Devices to provide services associated with any third-party Mobile Applications that Users download, install, use, or otherwise interact with over an ZBrains’s platform. ZBrains’s Mobile Applications may also contain links or integrations to other Mobile Applications provided by third parties. Third parties’ use of information collected through third-party Mobile Applications is governed by the privacy statements of such third parties. The Company encourages all ZBrains Visitors and/or Customers to review the privacy statements of third-party providers of Mobile Applications to understand their information practices.
Notices and contractual terms related to a particular Mobile Application may be found in the End User License Agreement or relevant terms of service for that application. The Company encourages all ZBrains Visitors and/or Customers to review the End User License Agreement or relevant terms of service related to any Mobile Applications one may download, install, use, or otherwise interact with to understand that Mobile Application’s information practices. The Mobile Application’s access to information through a User’s Device does not cause that information to be “Customer Data” under ZBrains’s MSA with the Customer or under this Privacy Statement, except as follows: To the extent that a User uses a Mobile Application to submit electronic data and information to a Customer account pursuant to the Customer’s MSA with ZBrains (or a similar agreement that governs the Customer’s subscription(s) to ZBrains’s Services), that information constitutes “Customer Data” as defined in such agreement, and the provisions of that agreement with respect to privacy and security of such data will apply.
§10. Changes to this Privacy Statement.
ZBrains reserves the right to change this Privacy Statement. ZBrains will provide notification of the material changes to this Privacy Statement through the Company’s website(s) at least thirty (30) business days prior to the change taking effect.
§11. ZBrains’s Visitors and/or Customers’ Consent.
By using the ZBrains website(s) in any way, either as a casual Visitor or purchasing Customer, the use of the ZBrains website(s) constitutes consent to the terms of this Privacy Statement.
§12. Procedure for ZBrains Visitors and/or Customers to View/Correct Personal Information.
As an individual ZBrains Visitor and/or Customer to the Company’s website(s), such Visitors and/or Customers may exercise their right to access the data held about themselves by this Company by submitting a request in writing to the address in Section 13 below. Although all reasonable efforts will be made to keep Visitors and/or Customers’ information updated and correct, said ZBrains Visitors and/or Customers are kindly requested to inform ZBrains of any change referring to the personal data held by the Company. In any case where Visitors and/or Customers consider that certain information about them is inaccurate, they may request rectification of such data via direct written correspondence to the Company address below in Section 13. ZBrains’s Visitors and/or Customers also have the right to request the blocking or erasure of data that has been processed unlawfully.
